Senator Cruz Eligibility

Ballot creation date: 03/16/2015

Fact: The US Constitution states that, “No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President”. Fact: ‘Natural born’ has also been determined to be born in a US Territory if a parent was a US Citizen, such as Senator McCain was when Panama was a US Territory ((8 U.S.C. § 1403(a), the law states that anyone born in the Canal Zone or in Panama itself to a mother or father who is a United States citizen on or after February 26, 1904, is declared to be a naturalized United States citizen at birth.)) Fact: Senator Cruz was born in Calgary, Canada.

Analysis and Conclusion relative to theft:

The writers of the US Constitution not only placed great importance on place of birth as a requirement for the highest office in the land, but also a residency requirement of fourteen years inside the United States. They did this because of the historically high probability that loyalty to the country of one’s birth provides, and because of the adaptation to culture that residency contributes to that loyalty which money, connections, and outside powers of influence may not otherwise provide. The place of birth was of high importance to establish during the candidacy of President Obama, and documentation relative to his birth certificate was accepted by most to show he was born in the United States or any US territory. The birth place of the incumbent President remains a question to some. The birth place of Senator Cruz is not a question to anyone. Also, Americans are tired of the term, 'birther' as being a negative label for anyone whether well-intended or not. And Senator cruise knows that anyone raising the Constitutional question of his place of birth in relation to the Presidency will be largely dismissed as 'just another Birther'.

There is nothing here against Senator Cruz or his known abilities except his endorsement for himself for the Presidency, especially after his emphasis on the importance of the original basic requirements of the US Constitution and disregard thereof. This is a too familiar political mode of operation where one is doing something while professing the opposite. Also, there are millions of Americans of all races who are qualified by natural birth place to be President. The requirement to be Naturally born here by the founders of this country just greatly reduced the probability that a pre-influenced person of a different culture and loyalty could be camouflaged for the highest job, but with a hidden unknown agenda. This concern was further mitigated by the Constitutional requirement that a President must have resided in the United States for 14 years (Over half the adult life of the minimum age requirement of 35 years.) This precaution was taken because of the immense powers given to the Office of President that allowed interim decisions that could cause permanent damage. Basically, this birth requirement contributed to peace of mind by eliminating anxiety that a person born elsewhere would provide to many. This requirement seems as germane to historical lessons then as since. The Kings of Europe, for example, were often not born in the country and culture of the peoples over which they had power with often devastating results to the quality of life and health of those people. Alexander the Great was not Greek born, Genghis Khan was not Chinese born, and since then, Napoleon was not French born, Stalin was not Russian born, and Hitler was not German born. But perhaps human nature has changed, and the ‘Providence’ of birth place and culture is considered some sort of insult to Citizens of the US rather than the appreciation that used to come with just being a Citizen of the US. This MOT Ballot  weighs the degree of theft from the integrity of the whole Constitution that an endorsement of Senator Cruz for eligibility to become President would contribute.
